Rosen Harwood’s Environmental Practice Group combines years of experience in litigation and regulatory compliance with backgrounds in natural resource sciences to provide comprehensive representation in environmental matters. Environmental Regulation and Compliance

Our attorneys routinely assist clients in understanding the complex environmental regulatory landscape which impacts both transactions and the development and operation of both public and private entities. This includes the preparation of environmental assessments and environmental impact statements. Our attorneys are also experienced in environmental matters related to natural resource damages assessments, claims, and restoration planning, particularly with respect to the Deepwater Horizon oil spill. Our attorneys also regularly work with various state and federal regulatory agencies, including the Alabama Department of Environmental Management (ADEM) and the United States Environmental Protection Agency (EPA), to resolve client issues effectively and efficiently.

We regularly deal with the legal and regulatory issues that arise from industrial, commercial and residential development including NPDES permitting, enforcement actions and litigation. Likewise, our attorneys are also experienced in dealing with issues that arise from the removal and disposal of hazardous materials from industrial and commercial facilities. We also have experience in addressing indoor air quality issues arising from asbestos, mold and other environmental toxins.

The experience gleaned from our regulatory and compliance work helps our attorneys advise clients in such a way to minimize the risk of environmental litigation.

Environmental Litigation

Rosen Harwood attorneys have represented numerous businesses and business owners in the defense of various environmental claims relating to development, pipelines, plants, underground storage tanks, and other environmentally sensitive facilities. We have also represented governmental entities in matters against potentially responsible parties (PRPs) and non-governmental organizations (NGOs) in National Environmental Policy Act and Oil Pollution Act matters. Our attorneys have also represented individual plaintiffs in various actions against a variety of polluters.
